Palm Springs Dog Bite Lawyer

Can I sue if I was attacked by a dog?

Under California state law, it is possible for the victim of a dog attack to sue the dog's owner for monetary damages. Many states across the country use the antiquated "one-bite rule," which holds that the dog's owner cannot be held responsible for the first time the animal attacks and which requires the victim to demonstrate that the dog had a known history of attacks or of aggressive and violent behavior. In California, however, the owner can be held liable for a bite under certain circumstances.

In order to recover financial compensation for a dog bite, you will have to demonstrate that the attack occurred in a public place or on the owner's property and that you were there lawfully and were not trespassing. It is also necessary that you were not willfully negligent and that you did not provoke the animal to attack. In cases in which the victim is a child younger than five years of age, the law does not impose these requirements, as small children are legally incapable of negligence or of provocation.

Fight for compensation with help from Stern Law Group!

If successful, your personal injury or wrongful death claim could provide you with an insurance settlement or jury verdict to pay for all of your medical expenses and lost income, as well as damages for pain, suffering, emotional distress, disfigurement and loss of companionship. You may additionally be able to claim punitive damages if it can be demonstrated that the dog's owner intentionally incited the dog to attack. It would be difficult to overstate the negative impact of a dog bite on the life of the victim, as you or your child may have been left with serious scarring and emotional trauma that will never fully heal.
